RE: The tariff classification of a women’s sweater from Hong Kong

Dear Ms. Fox:

In your letter dated May 3, 2005, you requested a classification ruling on behalf of Jones Apparel Group.

A sample of a women’s sweater, identified as style M21E80088 was submitted and will be returned as you have requested. The knit garment features a shawl collar, a full front opening secured with a snap, and long sleeves. The outer surface of the garment measures less than 9 stitches per 2 centimeters in the direction in which the stitches were formed. A laboratory report was submitted detailing the fiber content of the garment. The fabric is knit using three yarns. The first yarn is made of 100% rayon: the second yarn is made of 63.7% polyester and 36.3% metallic; and the third yarn is made of 83.1% rayon and 16.9% nylon. The relative weight by percentage of each of the yarns that comprise the fabric is 11.8% of the first yarn, 2.6% of the second yarn, and 85.6% of the third yarn. The overall fiber content is stated to be 83.2% rayon, 14.4% nylon, 1.5% polyester, and .9% metallic.

The applicable subheading for style M21E80088 will be 6110.30.3020, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pulloversand similar articles, knitted or crocheted: Of man-made fibers: Other: Other: Other: Other: Sweaters: Women’s. The duty rate will be 32% ad valorem.
