RE: The tariff classification of Christmas decorations from China.

Dear Mr. Stinson:

In your letter dated April 25, 2005, you requested a classification ruling.

The submitted sample is identified as item number 941534, XTT Christmas Wreath Animated FO Couple. The wreath is composed of white plastic strips that are bound together with wire to appear as pine branches. The circular wreath has a wire backing that forms the frame. The Christmas wreath is decorated with snowflakes, two stuffed snowmen figures and fading in and out LED light. A battery compartment is attached to the back of the wreath that houses 3 “AA” batteries. When the battery switch is turned on the music plays “Let It Snow”. The snowmen figures move as the music plays. The wreath measure approximately 18 inches in diameter. The wreath is imparts the essential character to this item.

The sample is returned as you requested.

The applicable subheading for the Christmas wreath will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
