RE: The tariff classification of a coin purse, ponytail holders and barrettes from China.

Dear Mr. Williams:

In your letter dated April 22, 2005, you requested a tariff classification ruling.

The sample submitted is identified as a “Valentine Bag With Accessories”, style number 50049. The item consists of a heart shaped coin purse with clip on clasp. It will be sold with 3 knit ponytail holders and 3 plastic barrettes. The purse is manufactured of polyvinyl chloride (PVC) plastic sheeting. It measures approximately 3 ¾”(H) x 4”(W) x 1 ¾”(D). It is secured by means of a zippered closure. Your sample is being returned as requested.

The applicable subheading for the coin purse will be 4202.32.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of a kind normally carried in the pocket or in the handbag, with outer surface of sheeting of plastic, other. The rate of duty will be 20 percent ad valorem.

The applicable subheading for the ponytail holders will be 6117.80.8500, HTS, which provides for other made up clothing accessories: knitted or crocheted; knitted or crocheted parts of clothing accessories: other accessories: other: headbands, ponytail holders and similar articles. The rate of duty will be 14.6 percent ad valorem.

The applicable subheading for the plastic barrettes will be 9615.11.4000, HTS, which provides for combs, hair-slides and the like; of hard rubber or plastic: other: not set with imitation pearls or imitation gemstones. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
