RE: THE COUNTRY OF ORIGIN MARKING OF PAPERBOARD BOXES AND INSERTS

Gentlemen:

This is in response to your letter dated April 26, 2005, on behalf of your client, MCR Printing and Packaging, requesting a ruling on whether certain folding cartons and “inserts”, of paper or paperboard, imported from Mexico, are required to be individually marked with their country of origin.

Samples were submitted. The folding box will be imported “set up”; i.e., folded and glued. It measures 3 7/8” x 2 1/8” x ½”, and has an extended “header” for hanging the box on a retail sale rack. The header is the length of the box x ¾ inch, and is pierced to accommodate hanging on a wire.

The “inserts” are flat, printed and pierced shapes of paperboard, the larger having maximum dimensions of 9 5/16 inches x 5 11/16 inches. In use they will be folded or otherwise arranged so as to serve as “holders” of merchandise.

These products are considered to be “Containers or holders not designed for or capable of reuse”, imported empty, within the intendment of 19 C.F.R. 134.24. They are clearly such as will be packed and sold in multiple units (dozens, gross, etc.)

Pursuant to 19 C.F.R. 134.24 (b) the requirement that they be individually marked to indicate their own country of origin “ordinarily will be met by marking the outermost container which reaches the ultimate purchaser”.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR Part 177).
