RE: The tariff classification of women’s jackets from Hong Kong

Dear Ms. Fox:

In your letter dated April 27, 2005, you requested a tariff classification ruling on behalf of Jones Apparel Group. The submitted samples will be returned to you as requested.

Style M3J32X776 is a woman’s jacket constructed from 58 percent cotton and 42 percent linen woven fabric. The jacket features long sleeves with two button closures, a collar, epaulets, two chest pockets with buttoned flaps, two pockets below the waist with flaps and a full front opening secured by five buttons. The jacket also has a back center pleat and back vents.

Style M3J41Y485 is a woman’s jacket constructed from 74 percent cotton and 26 percent polyester woven fabric. The jacket features long sleeves, a mandarin collar, epaulets, two chest pockets with buttoned flaps, two pockets below the waist with buttoned flaps and a full front opening secured by five buttons.

The applicable subheading for both jackets will be 6204.32.2010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): suit-type jackets and blazers: of cotton: other: other: women’s. The duty rate will be 9.4 percent ad valorem.

Both jackets fall within textile category designation 335. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
