RE: The tariff classification of a women’s cardigan from China.

Dear Ms. Gong:

In your letter dated April 28, 2005, you requested a classification ruling on behalf of Norton McNaughton of Squire, Inc.

You submitted a sample of a woman’s cardigan identified as style DSAH69. The garment is made of 100% finely knitted cotton fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters counted in the direction in which the stitches were formed. The garment features a full front opening with zippered closure, a mock turtle neck collar, long sleeves with rib knit cuffs, princess seams, and a straight hemmed bottom. The garment also features floral embroidery on the upper left front panel, and along the sides of the sleeves, and embroidered stitches along the neckline, princess seams, sleeve cuffs, and garment bottom. Your sample will be returned as you have requested.

The applicable subheading for style DSAH69 will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pulloversand similar articles, knitted or crocheted: Of cotton: Other: Other: Other: Women’s or girls’. The duty rate will be 16.5% ad valorem.

Style DSAH69 falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
