RE: The tariff classification of Christmas decorations from China.

Dear Mr. Stinson:

In your letter dated April 14, 2005, you requested a classification ruling.

The submitted samples are identified as assortment number 942137, XHD Christmas Tree Tea light Holder. This item is composed of 100 percent stoneware and measures 5.5 inches long by 3 inches wide by 9.5 inches high. The Christmas tree is designed with star shape cut outs in various locations with a star on the top. The backside of the Christmas tree has an opening that allows a tea light candle to be placed inside for illumination of the Christmas tree. The Christmas tree appears to be decorated with stars.

The sample is returned as you requested.

The applicable subheading for the Christmas Tree Tea light Holder will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive...articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
