RE: The tariff classification of an ammunition belt and an ammunition case from China

Dear Ms. Antrim-Saizan:

In your letter dated April 12, 2005, you requested a tariff classification ruling on behalf of HYI Hawe Yue, of Covina, California.

The first submitted sample is identified as Model FS-060 “No Flight Zone.” It is an ammunition/gun shell belt that is constructed of nylon fabric covered neoprene in a camouflage print. It is designed to hold 25 rounds in individual slots spaced along 29 inches of neoprene. Stitched onto either end are two 2” webbed straps measuring 15” in length and ending in plastic buckles. You indicate that the item is worn around the waist or hips so that ammunition is easily accessible while hunting.

The applicable subheading for the Model FS-060 “No Flight Zone” ammunition belt will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem.

The other submitted sample is identified as Model FS-070 “Loaded Transporter.” Also constructed of nylon fabric covered neoprene in a “camo” print, it is a case that is designed to hold 24 rounds in individual slots spaced along two sides. The case measures 13” x 5”. There is a zippered center compartment. It has two spring clips on the upper edge and two D-rings on the bottom that you state are intended for wader adaptation.

The applicable subheading for the Model FS-070 “Loaded Transporter” ammunition case will be 4202.92.9026, HTS, which provides for trunks, suitcasesholsters, and similar containers, other, other, of man-made fibers. The rate of duty will be 17.6 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
