RE: The tariff classification of a ceramic planter from China

Dear Ms. Powell:

In your letter dated April 12, 2005, you requested a tariff classification ruling. A representative sample and a picture of the item you wish to import were submitted with your ruling request.

The submitted sample, designated in your letter as article catalogue number 0518 and 0518A, is a ceramic (non-porcelain) planter in the shape of a pumpkin with a removable pumpkin stem lid. The stem on the lid is decorated with two textile leaves and metal wire. You indicated in your letter that the ceramic planter will be imported with a wire pick. The wire pick, which is removable, is designed to hold up the lid.

You stated in your letter that this product is sold to individual florists for use in floral arrangements. The measurements are approximately 4 ½ inches in height and 5 inches in diameter at the top opening.

The applicable subheading for the ceramic planter with wire pick will be 6913.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for statuettes and other ornamental ceramic articles: other: other: other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
