RE: The tariff classification of a woman’s shirt from China

Dear Mr. Stack:

In your letter dated April 11, 2005, you requested a tariff classification ruling on behalf of Item Eyes, Inc. The submitted sample will be returned to you as requested.

Style 49204G is a woman’s shirt constructed from 58 percent cotton, 40 percent polyester and 2 percent spandex woven fabric. The shirt features ¾ length sleeves, a collar, two pockets below the waist and a full front opening secured by five buttons.

The applicable subheading for style 49204G will be 6211.42.0054, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206: with two or more colors in the warp and/or the filling: women’s. The duty rate will be 8.1 percent ad valorem.
