RE: The tariff classification of Satin Smooth Pure White Wax Instant Body Wax Strips, Model# SSCWB12, from Italy

Dear Ms. Ritchings:

In your letter dated March 7, 2005 you requested a tariff classification ruling. A sample was submitted for review with your ruling request.

The Satin Smooth Pure White Wax Instant Body Wax Strips is a depilatory. The item, packed for retail sale, contains 12 pre-waxed plastic strips and 2 cleansing oil towelettes. The wax strips are applied to the skin for the removal of body hair. The towelettes are applied to the skin to remove any wax residue. The sample is being returned as requested.

The applicable subheading for Satin Smooth Pure White Wax Instant Body Wax Strips will be 3307.90.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Pre-shave, shaving or after-shave preparations, personal deodorants, bath preparations, depilatories and other perfumery, cosmetic or toilet preparations, not elsewhere specified or included; prepared room deodorizers, whether or not perfumed or having disinfectant properties: Other.. The rate of duty will be 5.4 percent ad valorem.
