RE: The tariff classification of floral packaging material from China

Dear Ms. Araki:

In your letter dated July 26, 2005, you requested a tariff classification ruling on behalf of your client, Westland Floral Company, of Carpinteria, California.

The submitted samples are identified as materials that will be imported in sheets with a cross cut in the middle. This cross cut makes the articles made up in terms of Note 7 to Section XI, Harmonized Tariff Schedule of the United States (HTS). You indicate that one of these will be placed in a clear floral sleeve and cut flowers will then be placed in the middle of those two layers for retail packaging presentation purposes. The composition of the items is:

A) Non-woven – 100 percent polypropylene B) Organza – 100 percent polyamide C) Mesh – 100 percent polypropylene

The applicable subheading for the floral packaging material will be 6307.90.9889, HTS, which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).

A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported. If you have any questions regarding the ruling, contact National Import Specialist Mitchel Bayer at 646-733-3102.

Sincerely,

Robert B. Swierupski
