RE: The tariff classification of a woman’s knit cardigan from Malaysia

Dear Mr. Spoto:

In your letter dated March 29, 2005, you requested a classification ruling on behalf of Cullen, Inc., New York, NY. As requested, your sample is being returned to you.

Your sample, style F58062-COS, is a woman’s cardigan constructed from 100% cotton knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a hood, long sleeves finished with tubular fabric, a full front zippered opening, kangaroo pockets, and a tubular bottom that does not provide a tightening at the waist.

The applicable subheading for style F58062-COS will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s. The duty rate will be 16.5% ad valorem.

Style F58062-COS falls within textile category designation 339. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
