RE: The tariff classification of a man’s shirt from China.

Dear Ms. Stubblefield:

In your letter dated March 21, 2005, you requested a tariff classification ruling. As requested, your sample will be returned.

Style P2101 is a man’s shirt constructed from 65 percent polyester, 35 percent cotton, solid color, woven twill fabric. Style P2101 features a button-down collar; a left over right full front opening with seven button closures; long sleeves with buttoned cuffs; a pocket on the left chest; and a curved, hemmed bottom. The shirt will be imported in men’s sizes XS-4XL. The same garment will be imported as Style P2101Y in boys’ (youth) sizes YXS-YXL.

The applicable subheading for Style P2101 will be 6205.30.2070 which provides for men’s or boys’ shirts, of man-made fibers, other: other: other: men’s. The duty rate is 29.1cents per kg. plus 25.9% percent ad valorem.

The applicable subheading for Style P2101Y will be 6205.30.2080 which provides for men’s or boys’ shirts, of man-made fibers, other: other: other: boys’: other. The duty rate is 29.1 cent per kg. plus 25.9% ad valorem.

Styles P2101 and P2101Y fall within textile category designation 640. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
