RE: The tariff classification of a beaded closure from China.

Dear Mr. Bulmash:

In your letter dated March 21, 2005, you requested a tariff classification ruling.

The submitted sample is identified as a beaded closure, sample #04-1275. The item consists of a strand of wire that has been bent in half and twisted. The wire is formed into a loop with the ends secured. Attached to the wire are strands of wire to which variously sized beads have been attached. The material breakdown is: 30% wire, 60% acrylic and 10% plastic. You have also submitted a photograph of the beaded closure with the intended use as a decorative textile gift-wrap closure.

The applicable subheading for the beaded closure will be 3926.90.3500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other articles of plasticsOther: Beads, bugles and spangles, not strung (except temporarily) and not set; articles thereof, not elsewhere specified or included: Other.” The rate of duty will be 6.5% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
