RE: The tariff classification of hunting vests from China.

Dear Mr. Stein:

In your letter dated February 23, 2005, on behalf of Walls Industries, Inc., you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample, style 38440HWG, is a uni-sex hunting vest composed of woven 55% cotton and 45% polyester fabric. The garment features padded shoulders with adjustable straps; two large outside zippered pockets with shell loops; two inside pockets; decoy stake pocket; back with concealable safety flag; removable padded seat; large expandable nylon lined game bag with decoy stake pockets; and license loop. You state that styles 38440AT and 38440HW are identical to style 14544801, except for the fabric pattern.

The applicable subheading for styles 38440HWG, 38440AT and 38440HW will be 6211.42.0070, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton, vests. The duty rate will be 8.1 percent ad valorem.

Styles 38440HWG, 38440AT and 38440HW fall within textile category designation 359. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
