RE: The tariff classification of a woman’s knit vest from Macau

Dear Ms. Parker:

In your letter dated March 15, 2005, you requested a classification ruling on behalf of Koret of CA, Oakland, CA.

Your sample, style PKG256 S9487, is a woman’s vest constructed from 85% acrylic, 15% wool knit fabric. The back panel is constructed from a 2x2 rib knit fabric. The two front panels are constructed from a pile knit fabric. The outer surface of the pile fabric of the front panels measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a round neckline, oversized sleeveless armholes, a full woven lining on the front panels, and a full front zippered opening. The neckline, armholes, placket, and bottom are finished with 2x2 rib knit fabric.

The essential character of style PKG256 S9487 is given by the pile knit fabric of the front panels, Harmonized Tariff Schedule of the United States (HTS), General Rules of Interpretation (GRI), Rule 3, noted.

In your ruling request, you recommended classification of the submitted garment under HTS 6211.43.0076. It is noted that style PKG256 S9487 is constructed from knit fabric; thus, is provided for in 6110.

The applicable subheading for style PKG256 S9487 will be 6110.30.3035, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: vests, other than sweater vests: women’s. The duty rate will be 32% ad valorem.
