RE: The tariff classification of gloves from China.

Dear Ms. McCabe:

In your letter dated July 21, 2005, you requested a tariff classification ruling. The submitted sample will be returned as per your request.

Style 70A6 is a ladies’ gardening glove with a palmside from the fingertips to the wrist constructed of a knitted 77% cotton 20% polyester 3% spandex fabric with a PVC mini-dot coating on the outer surface. The weight breakdown of the coated palmside fabric is 54% cotton 17% polyester 2% spandex 27% PVC coating. The backside of the glove, the cuff and the fourchettes are made of a knitted fabric. The glove also features a hemmed bottom. You have indicated the glove will be available in a different color as style TG668D. The essential character of the glove is imparted by the knitted coated palmside fabric.

The applicable subheading for both styles will be 6116.10.7510, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other: with fourchettes: containing 50 percent or more by weight of cotton, man-made fibers or other textile fibers, or any combination thereof . . . subject to cotton restraints. The duty rate will be 13.2 percent ad valorem.

The glove falls within textile category designation 331. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
