RE: The tariff classification of novelty chaps from China.

Dear Ms. Sousa:

In your letter dated July 11, 2005, you requested a classification ruling. As requested by separate letter the sample will be returned to you.

Your submitted sample, style 996-49B Ripoff Chaps is a novelty item. The man’s item is constructed of 85% nylon and 15% spandex fabric. The hip length brief style features an enclosed elasticized waist, no back or front panel, and fastens around the waist and upper leg portion by hook and loop closure.

The applicable subheading for the style 996-49B will be 6114.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of man-made fibers: other, other: men’s or boys’. The duty rate will be 14.9 percent ad valorem.

Style 996-49B falls within textile category designation 659. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
