RE: The tariff classification of a glove from China.

Dear Mr. Sachs:

In your letter dated March 3, 2005, you requested a tariff classification ruling.

Style 91-2778T-MO is a lined and insulated glove constructed of a 90% polyester 10% spandex weft knitted fabric with an outer surface printed with a camouflage pattern. A coated fabric overlay is located on four of the palmside fingers extending to the lower palm area and on the fingertip of the palmside thumb. The glove also features a 2-inch cuff and fourchettes. The camouflage printed glove shows design suitable for the sport of hunting. The essential character of the glove is imparted by the knitted synthetic fabric shell material. Knitted synthetic fabric sports gloves are provided for under 6116.93.0800, HTS. Therefore, your suggestion for classification under 6216.00.0800, HTS, is not applicable.

Style 91-1767T-MO is a glove constructed with a complete palmside made of a perforated 92% polyester 8% spandex weft knitted fabric with a plastic mini-dot coated camouflage-printed outer surface. An uncoated version of the same fabric comprises the balance of the glove. The glove features a 2-inch cuff and fourchettes. You have indicated the glove will also be available in the same composition without the palmside plastic dot coating as style 91-1768T-MO. The camouflage printed gloves show design suitable for the sport of warm weather hunting. The essential character of Style 91-1767T-MO is imparted by the palmside coated knitted fabric. The essential character of Style 91-1768T-MO is imparted by the knitted synthetic fabric shell material.

Style 91-1777T-MO is a glove constructed with a complete palmside made of a 90% polyester 10% spandex weft knitted fabric with a plastic mini-dot coated camouflage-printed outer surface. An uncoated version of the fabric comprises the balance of the glove. The glove features a 2-inch cuff and fourchettes. The camouflage printed glove shows design suitable for the sport of warm weather hunting. The essential character of the glove is imparted by the palmside coated knitted fabric.

Plastic coated knitted fabric sport gloves are provided for under 6116.10.0800, HTS. Therefore, your suggested classification under 6216.00.0800, HTS, for styles 91-1767T-MO and 91-1777T-MO is not applicable.

The applicable subheading for the Styles 91-2778T-MO and 91-1768T-MO will be 6116.93.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8 percent ad valorem.

The applicable subheading for the Styles 91-1767T-MO and 91-1777T-MO will be 6116.10.0800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
