RE: The tariff classification of a hat from China.

Dear Mr./Ms. Stubblefield:

In your letter dated March 3, 2005 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style P1961 is a hat composed of knit acrylic fabric. The hat is a ski style hat that can be worn with or without a cuff.

The applicable subheading for the style P1961 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of man-made fibers: Knitted or crocheted or made or from knitted or crocheted fabric: Not in part of braid, Other: Other, Other." The duty rate will be 20 cents/kg + 7% ad valorem. The textile category designation is 659.
