RE: The tariff classification of a child’s costume from China.

Dear Ms. Crago:

In your letter dated January 31, 2005 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style C079BA00449, Angel Costume Set consists of a long dress, halo and belt. The dress is composed of knit velour polyester fabric. The garment has long transparent sleeves and marabou feather trim on the cuffs and neckline. The dress is well made with styling and a finished neckline and edges.

GRI 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the dress imparts the essential character of the set.

The applicable subheading for the Angel Costume Set, style C079BA00449 will be 6104.43.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for "Women’s or girls’dressesknitted or crocheted: Dresses: Of synthetic fibers: Girls’." The duty rate will be 16% ad valorem. The textile category designation is 636.
