RE: The tariff classification of a woman’s blouse from Turkey

Dear Ms. Julia:

In your letter dated February 22, 2005, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style S05-211-20 is a woman’s blouse composed of knit and woven components. The back panel, sleeves and front waistband are constructed from 100 percent cotton knit fabric and the front panels are constructed from 100 percent rayon woven fabric. The blouse features a V-neckline, long sleeves and a full front opening secured by six buttons.

Because the garment is constructed of both knitted and woven components it is considered a composite good, and based upon GRI 3(b) classified by the component that provides the essential character. In this case, because the entire front of the garment consists of the woven fabric, that is the component which imparts the essential character to the garment. The garment will be classified in Chapter 62 under the subheading for blouses.

The applicable subheading for the style S05-211-20 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

Style S05-211-20 falls within textile category designation 641. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
