RE: The tariff classification of a hook and a card holder from China

Dear Ms. Marcoux:

In your letter dated February 18, 2005, you requested a tariff classification ruling.

The first item is the Ladybug Double Hook (Sku number 29030) made of galvanized base metal. It has a ring at its top to facilitate hanging, a circular mesh backing, and three dimensional accents, which include a ladybug, flowers and leaves. The double hook can hold clothing, hats, towels, etc.

The second item is a Santa card holder (Sku number 28490) made of steel. It can hold up to twenty five cards and hangs from a hanger that fits over most doors.

The applicable subheading for the double hook will be 8302.50.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for base metal mountings, fittings and similar articles, hat-racks, hat pegs, brackets and similar fixtures, and parts thereof. The rate of duty will be free.

The applicable subheading for the Santa card holder will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for festive, carnival or other entertainment articles, articles for Christmas festivities and parts and accessories thereof, Christmas ornaments, other, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
