RE: The tariff classification of a belt from China.

Dear Ms. De Silva:

In your letter dated February 14, 2005 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample is a lady’s laser-cut design belt. The belt is composed of polyurethane cellular plastic material on the outer surface and woven 100% cotton on the inner surface. Both fabrics gird the waist.

Neither the polyurethane plastic material, classifiable under heading 3926, nor the woven cotton fabric, classifiable under heading 6217, imparts the essential character to the belt. Following General Rule of Interpretation (GRI) 3 (c), it will be classified under the heading which occurs last in numerical order in the HTS

The applicable subheading for the laser cut-design belt will be 6217.10.9510, Harmonized Tariff Schedule of the United States (HTS), which provides for "Other made up clothing accessories; parts of garments or of clothing accessories, other than those of heading 6212: Accessories: Other: Other, Of cotton." The duty rate will be 14.6% ad valorem. The textile category is 359.
