RE: The tariff classification of two women’s cardigans from Macau

Dear Ms. Stover:

In your letter dated February 8, 2005, you requested a tariff classification ruling.

You submitted two samples of women’s cardigans.

Style 9282-33W is constructed from 100% polyester, knit fabric with 100% nylon woven overlays on the sleeves, the shoulders, and the collar. The outer surface of the knit fabric of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The cardigan features a mock collar, long hemmed raglan sleeves, a full front opening with a zipper closure, 2 front inset zippered pockets in the waist area, and a hemmed bottom. The left sleeve has a zippered pocket in the shoulder area. Piping finishes the armhole and collar areas.

Style 9794-14W is constructed from 100% polyester, fleece knit fabric. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the horizontal direction. The garment features a mock collar, long raglan sleeves, a full front opening with a zipper closure, and 2 front inset pockets in the waist area. The sleeves and the bottom are finished with loose fitting spandex capping. Decorative stitching appears on areas of the garment.

The garments are classified under item 6110.30.3055, Harmonized Tariff Schedule of the United States (HTS). They are precluded from 6102, HTS, as outerwear jackets because they have neither tightening at the sleeve openings nor the bottom.

The applicable subheading for each cardigan will be 6110.30.3055, (HTS), which provides for sweatersand similar articles, knitted: of man-made fibers: otherother: women’s. The rate of duty will be 32% ad valorem.

Each cardigan falls within textile category designation 639. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
