RE: The tariff classification of travel utility pouches from China.

Dear Mr. Hoffacker:

In your letter dated February 3, 2005, on behalf of Raymond Geddes & Co., Inc., you requested a classification ruling for travel utility pouches.

The samples submitted are identified as item numbers 66585 “Rainbow Shag Bag’, 66584 “Pueblo Pencil Pouch”, and 65862 “Squishy Squares Pencil Pouch”. The items are generic utility pouches designed to contain personal effects during travel. Items 66585 and 66584 are manufactured with and exterior surface of man-made fiber textile materials. Item 65862 is manufactured of polyvinyl chloride (PVC) plastic sheeting. The pouches are unlined and ranges in size from approximately 7 inches wide by 2 inches in diameter to 9 inches wide by 2 ½ inches in diameter. The top of each pouch is secured by means of a zippered closure. Your samples are being returned as requested.

The applicable subheading for utility pouches of man-made fiber textile materials will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.6 percent ad valorem.

The applicable subheading for the utility pouches of PVC sheeting will be 4202.92.4500, HTS, which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The duty rate will be 20 percent ad valorem.

HTS 4202.92.3031 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
