RE: The tariff classification of cap from China.

Dear Mr. Lum:

In your letter dated, February 4, 2005, you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample style Hat-101 is a 98% cotton and 2% spandex woven baseball-style cap. The cap features six panels with air holes, a stitched peak, fabric covered button at the top and a sweatband.

The applicable subheading for style 101 will be 6505.90.2060, Harmonized Tariff Schedule of the United States (HTS), which provides for hats and headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed . . .: other: of cotton, flax or both not knitted: headwear of cotton, other. The duty rate will be 7.5 percent ad valorem.

Style 101 falls within textile category designation 359. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
