RE: The tariff classification of unisex immersion suit from Thailand.

Dear Ms. Forner:

In your letter dated January 6, 2005 you requested a tariff classification ruling. The sample will be returned to you as requested.

The submitted sample style I590 is a child’s Cold Water Immersion Suit with a foot covering. The coverall is composed of 5mm neoprene rubber laminated on both sides with knit fabric. The immersion suit has an inflatable value and head support, rubber foot covering (not a boot) and gloves. It will be used for abandoning ship. The suit will be imported with a textile PVC-coated storage bag. You state that style I590 with same fabric content is also made in adult sizes.

The applicable subheading for the child’s or adult size Cold Water Immersion Suit, style I590 with storage bag will be 6113.00.9070 “Garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907, Other, Overalls and coveralls: Other: Women's or girls'. The rate of duty will be 7.1% ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on style I595, Ice Rescue Suit. Your request for a classification ruling should include sample. It appears that style I595 has a boot and that may impact the classification. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
