RE: The tariff classification of three table sports games from China

Dear Ms. Habrial:

In your letter dated January 25, 2005, you requested a tariff classification ruling.

You are requesting the tariff classification on three table games as follows: item #08-6051, item #08-6052, and item #08-6053. Item #08-6051 contains .94 oz. of Silly Putty in a plastic soccer ball, a mini soccer net, 2 suction cups, and a soccer field play mat. Item #08-6052 is comprised of .94 oz. of Silly Putty in a plastic basketball, a mini basketball hoop and backboard, a stand for the hoop, 3 suction cups, and a basketball court play mat. Item #08-6053 is made up of the following: .94 oz. of Silly Putty in a plastic football, a mini goal post, a stand for the uprights, 3 suction cups, and a football field play mat. The samples will be returned, as requested.

The applicable subheading for the 3 table games: item #08-6051 (soccer), item #08-6052 (basketball), and item #08-6053 (football) will be 9504.90.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for arcade, table or parlor games, including pinball machines, bagatelle, billiards and special tables for casino games;parts and accessories thereof: other: otherother. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
