RE: The tariff classification of a projection clock radio from China.

Dear Ms. Ritchings:

In your letter dated December 21, 2004, you requested a tariff classification ruling. Sample is being returned as requested.

The subject merchandise, based on the submitted information, is a battery-operated projection clock radio, model number HCR1200Y, that is in the form of a miniature sports utility vehicle. The front windshield serves as an LCD clock display and the back windshield incorporates the light projector for displaying the time onto the ceiling. The bottom portion of this novelty device has a battery compartment, a radio on/off/auto selector, an AM/FM/voice selector, time selectors for the LCD clock and projection clock displays, and a DC jack. The front hood can be opened to operate the following features: an on/off switch for the projection light, mode and set buttons for the clock, a snooze button for the alarm time, and buttons for the LCD back light. The side windows have tuner and volume control dials, and the rear-back end has a light-demo button. This clock radio is not valued over $40 each.

The applicable subheading for the projection clock radio will be 8527.19.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for Reception apparatus for radiotelephony, radiotelegraphy or radiobroadcasting, whether or not combined, in the same housing, with sound recording or reproducing apparatus or a clock: Radiobroadcast receivers capable of operating without an external source of power, including apparatus capable of receiving also radiotelephony or radiotelegraphy: Other: Valued not over $40 each, incorporating a clock or clock-timer, not in combination with any other article, and not designed for motor vehicle installation. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
