RE: The tariff classification of a men’s knit pullover garment from China.

Dear Ms. Drummond:

In your letter dated December 20, 2004, which was received by this office on January 10, 2005, you requested a tariff classification ruling. Your response was delayed due to laboratory analysis.

Style 63231 is a men’s pullover garment constructed from jersey knit fabric that measures 16 stitches per two centimeters counted in the horizontal direction. The garment has a self-fabric spread collar, a partial front opening with four button closures, long sleeves with tubular knit cuffs, and a tubular knit bottom.

In your correspondence, you state that the fiber content for Style 63231 is 40 percent Tencel lycocell, 35 percent bamboo, 20 percent wool, and 5 percent silk. Laboratory analysis has found that the actual fiber content is 65.6 percent regenerated cellulose fibers (artificial fibers), 22.7 percent wool, and 11.7 percent silk.

Consequently, the applicable subheading for Style 63231 will be 6110.30.3050, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: men’s or boys’. The rate of duty is 32 per cent ad valorem.

Style 63231 falls within textile category designation 638. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
