RE: The tariff classification of men’s pants from Hong Kong.

Dear Mr. Maher:

In your letter dated December 30, 2004, you requested a tariff classification ruling on behalf of IFG Corporation. As requested, your sample will be returned.

Style MF-103 is a pair of men’s pants constructed from 100 nylon, woven fabric. The pants are fully lined with mesh knit fabric and feature a tunnel elastic waistband with an inside drawstring; two front quarter pockets; concealed mesh knit inserts at each side for ventilation; and hemmed legs with zipper openings at the ankles.

Although you state that the pants have a polyurethane coating, the coating is not visible. Consequently, the applicable subheading for Style MF-103 will be 6203.43.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’trousers: of synthetic fibers; other: other: other: other: trousers and breeches: men’s. The duty rate is 27.9% ad valorem.

Style MF-103 falls within textile category designation 647. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
