RE: The tariff classification of a telephone table, a kitchen island, a jelly cupboard, a bookcase and a secretary desk from China.

Dear Ms. Cordo:

In your letter dated December 22, 2004, on behalf of The Queens Treasures, you requested a tariff classification ruling.

The merchandise to be imported is as follows:

Item KF033-2 Telephone Table

Item CS 0029 Kitchen Island

Item CS 0025 Jelly Cupboard
Dimensions: 15.25” x 12.5” x 49”

Item CS 0011 Bookcase
Dimensions: 42.5” x 15.25” x 36.5”

Item CS 0021 Secretary Desk
Dimensions: unavailable

All of the items are made of solid camphor wood. You have submitted photographs of the items with your request.

The applicable subheading for the telephone table, the bookcase and the secretary desk will be 9403.60.8080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Other wooden furniture: Other, Other.” The rate of duty will be free.

The applicable subheading for the kitchen island and the jelly cupboard will be 9403.40.9080, HTS, which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the kitchen: Other: Other, Other.” The rate of duty will be free.

You have asked whether the items are subject to antidumping duties or countervailing duties.
