RE: The tariff classification of the “I-Swing Coach” from China

Dear Ms. Cecil:

In your letter dated October 29, 2004, you requested a tariff classification ruling, on behalf of Bernheim & Rice, your client.

You are requesting the tariff classification on an item that is described as an “I-Swing Coach”. The product is a golf training aid with a padded foam hitting area, full zippered upper lid with a snap closure, and a skid-resistant bottom with a hidden zipper and snap. The article, golf training equipment, is approximately 15 inches in diameter and 10 inches in height, packed in a clear PVC pouch. The correct classification will be in Chapter 95 of the HTS, as other golf accessories. The sample will be returned, as requested.

The applicable subheading for the “I-Swing Coach”, no style number shown, will be 9506.39.0080, Harmonized Tariff Schedule of the United States (HTS), which provides for articles and equipment for general physical exercise, gymnastics, athletics, other sportsparts and accessories thereof: golf clubs and other golf equipment; parts and accessories thereof: otherother. The rate of duty will be 4.9% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
