RE: The tariff classification of evening bags from Indonesia.

Dear Mr. Collins:

In your undated letter, received in this office October 13, 2004, you requested a classification ruling for evening bags.

The samples submitted are identified as items 1 & 2.

Item 1 is a ladies evening bag measuring approximately 8”(W) x 7”(H). The body of the bag is mainly covered on the exterior with glass beads. The bag has an interior satin textile lining, two glass beaded carrying handles and a metal magnetic snap closure.

Item 2 is a ladies evening bag designed to contain the small personal effects normally carried on a daily basis. It is manufactured with an exterior surface of man-made fiber textile materials decorated with glass beads. The bag features a satin textile lined interior compartment with no additional features. The top of the bag is secured by means of a metal magnetic snap fastener. The bag measures approximately 6 ½”(H) x 7”(W) with double carrying straps.

The applicable subheading for item 1, the handbag of glass beads, will be, 7018.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for glass beads and articles thereof other: other. The duty rate will be 6.6 percent ad valorem.

Articles classifiable under subheading 7018.90.5000, HTS, which are products of Indonesia, are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check our Web site at www.cbp.gov and search for the term "GSP".

The applicable subheading for item 2, the evening bag of textile materials, will be 4202.22.8050, HTS, which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTS 4202.22.8050 falls within textile category designation 670. Based upon international textile trade agreements products of Indonesia are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
