RE: The tariff classification of a glass Christmas tree ornament from China or Hong Kong.

Dear Ms. Powell:

In your letter dated June 17, 2004, you requested a classification ruling.

The submitted sample is identified as article number 042160. It is a glass Christmas tree ornament in a cardboard gift box. The oval shaped Christmas tree ornament is designed with a decorated Christmas tree on both sides. There are presents under the tree. The Christmas tree ornament has a gold braided cord attached to the top. Your letter of inquiry states that this ornament will be used in floral arrangements or sold as a gift.

The applicable subheading for the glass Christmas tree ornament will be 9505.10.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Of glass. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
