RE: The tariff classification of infants’ upperbody garment from China

Dear Mr. del Mundo:

In your letter dated June 11, 2004 you requested a classification ruling.

Submitted style 100000307, is a quilted, polyfill jacket. It is hip-length and has a flared bottom. It is characterized by long sleeves, a double breasted, full front button opening, a collar and turned over fabric at the cuffs. The outer shell is 80% cotton, 20% polyester knit velour fabric, the interior is polyfill and the lining jersey cotton. The item is sized for infants’ newborn to 12 months of age.

As you requested, the sample will be returned to you..

The applicable subheading for style 100000307 will be 6111.20.6040, Harmonized Tariff Schedule of the United States (HTS), which provides for babies’ garments and clothing accessories, knitted or crocheted, of cotton, other, other. The duty rate will be 8.1 percent ad valorem.

Style 100000307 falls within textile category designation 239. Based upon international textile trade agreements products of China are not currently subject to quota or the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
