RE: The tariff classification of the Catz in My Purse from China

Dear Mr. Morse:

In your letter dated June 7, 2004, you requested a tariff classification ruling, on behalf of MGA Entertainment Inc., your client.

You are requesting the tariff classification on a product that is identified as Catz in My Purse which is comprised of a stuffed bobble head toy cat, a carrying bag that is actually a toy pet carrier, a plastic brush for the cat, and a textile toy sleeping pad. There are four variations on the theme; each one is made of a different fabric with a difference in each of the designs of the pet carrier (purse). The item #’s are as follows: 273554, 273561, 273578, and 273585. The carriers are constructed of corduroy (273554), velvet (273561), plastic sheeting (273578), and denim (273585). The product is not considered a set in 9503.70.0000, but will be classified as a toy representing an animal and its accessories. The samples will be returned, as requested.

The applicable subheading for the Catz in My Purse, items 273554, 273561, 273578, and 273585 will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for toys representing animals or non-human creatures...and parts and accessories thereof: other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
