RE: The tariff classification of a CIENA CN 2200 Managed Optical Ethernet Multiplexer from an unspecified country

Dear Mr. Mastroberti:

In your letter dated October 18, 2004, you requested a tariff classification ruling.

This ruling concerns the classification of a CIENA CN 2200 Managed Optical Ethernet Multiplexer.

The descriptive literature submitted states that the CIENA CN 2200 Managed Optical Ethernet Multiplexer is a carrier-grade, easy-to-deploy platform designed for Gigabit Ethernet (GbE) service applications. By integrating GbE transport and high speed 10 Gb/s optical networking, the CN 2200 offers a compelling economic model for GbE service delivery through unmatched ease of use, port density, invest-as-you-grow scalability and best-in-class fiver capacity utilization.

The CN 2200 multiplexes up to eight GbE services for transport over a 9.953 Gb/s (10 Gb/s) dense wavelength division multiplexer (DWDM) optical interface. This wire-like GbE transport provides guaranteed security, Quality of Service (QoS), and transparent support for all Internet Protocol (IP) an Ethernet-based protocols. In particular, microsecond latency further enhances service quality in delay sensitive applications, such as streaming video.

The applicable subheading for the CIENA CN 2200 Managed Optical Ethernet Multiplexer will be 8517.50.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other apparatus, for carrier-current line systems or for digital line systems: Other: Telegraphic: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
