RE: The tariff classification of shawls from Scotland.

Dear Ms. Thorburn:

In your letter dated September 28, 2004 you requested a classification ruling.

The submitted request is for five styles of shawls. You state that the fabric content for the shawls is follows: 1- Large square shawl “Empire”, size 55” x 55” composed of woven 70% wool, 30% silk fabric. 2- Oblong scarf “Plaid”, size 17” x 63” composed of woven 100% silk fabric. 3- Large shawl, “Persia” size 58” x 61” composed of woven 80% lambs wool, 20% cashmere fabric. 4- Large shawl “Alwar”, size 55” x 55” composed of woven 70% wool, 35% silk, 35% cashmere fabric. 5- Large shawl “Jodhpur”, size 55” x 55” composed of 30% wool, 35% silk, 35% cashmere fabric.

 The applicable subheading for the 2- Plaid, woven 100% silk scarf will be 6214.10.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for "Shawls, scarves, mufflers, mantillas, veils and the like: Of silk or silk waste: Containing 70 percent or more by weight of silk or silk waste." The duty rate will be 1.2% ad valorem. There is no quota or visa on this merchandise.  

The applicable subheading for the shawls 1- Empire, 3- Persia, 4- Alwar and 5- Jodhpur will be 6214.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Shawls, scarves, mufflers, veils and the like: Of wool or fine animal hair.” The rate of duty will be 6.7 percent ad valorem. The textile designation is 459.

Based upon international textile trade agreements products of Scotland are not subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
