Dear Ms. Mead:

In your letter dated March 5, 2004, you requested a ruling on tariff classification.

The merchandise is a door actuator. The door actuator consists of a gear motor in a plastic housing. The door controls the airflow, air temperature and air quality in the cabin of the automobile. The motor is a DC-motor, operating at less than 3 Watts. In your letter, you mention heading 8501.31.6000, HTS. That heading, however, does not include motors of an output not exceeding 37.5 Watts.

The applicable subheading for this product will be 8501.10.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for electric motors and generators, motors of an output not exceeding 37.5 W, of under 18.65 W, DC, other. The general rate of duty will be 4.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.).
