RE: The tariff classification of a clothesline from China

Dear Mr. Crago:

In your letter dated November 23, 2004, you requested a tariff classification ruling.

The submitted sample, identified as Item Number C0381A03973, is a three-strand twisted clothesline. You indicate that it will be imported in two different lengths. An eleven-meter line will be made from polyethylene and a sixty-meter version will be made from polypropylene. Both are made of textile filament yarns. For this reason, classification in Chapter 39, Harmonized Tariff Schedule of the United States (HTS), which covers plastics, would be incorrect. The sample appears to measure 4mm in diameter.

The applicable subheading for the plastic clothesline of either polyethylene or polypropylene will be 5607.49.1500, HTS, which provides for twine, cordage, ropes, and cables, whether or not plaited or braided and whether or not impregnated, coated, covered, or sheathed with rubber or plastics:Of polyethylene or polypropylene:Other:., not braided or plaited:,measuring less than 4.8 mm in diameter. The rate of duty will be 7 percent ad valorem.

Subheading 5607.49.1500, HTS, falls within textile category designation 201. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas,” which is available at our web site at www.cbp.gov. In addition, we suggest that you monitor current events with regard to textile quota and visa requirements at the web site for the Office of Textiles and Apparel of the Department of Commerce, at otexa.ita.doc.gov.

The sample will be returned as requested.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
