RE: The tariff classification of two women’s sweaters from Hong Kong

Dear Ms. Cheung:

In your letter dated November 30, 2004, you requested a tariff classification ruling. Your samples are being returned as requested.

You submitted two samples of women’s sweaters that are constructed from 100% Merino wool, knit fabric. The outer surface of the garments measures fewer than 9 stitches per 2 centimeters in the horizontal direction. The sweaters extend from the shoulder to the knee area.

Style 153201 features a turn down collar with embroidered designs, long sleeves with embroidered designs on the sleeve openings, a full front opening with 5 button closures, 2 front patch pockets in the waist area, and a tubular hemmed bottom.

Style 153204 features a rib knit collar, long tubular hemmed sleeves with elbow patches, a full front opening, a ribbed placket and 6 button closures, 2 front flap pockets in the waist area, and a tubular hemmed bottom.

The applicable subheading for each sweater will be 6110.11.0030, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, knitted: of wool or fine animal hair: of wool: sweaters: women’s. The rate of duty will be 16% ad valorem.

Each sweater falls within textile category designation 446. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
