RE: The tariff classification of a blanket from India.

Dear Mr. Sirico:

In your letter dated November 22, 2004 you requested a classification ruling on behalf of Franco Manufacturing Co., Inc.

The submitted samples, referred to as a Throw 1 – Mohair wool and Throw 2 – Open weave, are blankets. One blanket is stated to be made from 90 percent wool and 10 percent nylon woven fabric. The blanket measures approximately 54 x 65 inches exclusive of a 4- inch self fringe. The second blanket is hand woven and is made from 100 percent wool yarns. The multi-colored blanket measures approximately 60 x 64 inches exclusive of a 5 inch knotted fringe along each end. In their letter, the importer states that the principal use of both items is to provide additional warmth.

The applicable subheading for both blankets will be 6301.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for blankets and traveling rugs: blankets (other than electric blankets) and traveling rugs, of wool or fine animal hair not over 3 meters in length. The duty rate will be Free.

The blankets falls within textile category designation 464. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
