RE: The tariff classification of a multi-purpose cleaning cloth from China or Estonia.

Dear Ms. Desjardins:

In your letter dated November 19, 2004 you requested a classification ruling on behalf of Gerber Childrenswear Inc..

The submitted samples, identified as a 6-pack “wiapers”, are multi-purpose cleaning cloths. The cloths are made from 100 percent cotton woven fabric. They are comprised of two layers of fabric sewn along the edges. The cloths have rounded corners and measure approximately 10 x 10 inches. In your letter you note that the cloths will have multiple uses such as burp cloth, face cloth and a wiping cloth used in cleaning spills and messes.

The applicable subheading for the cloths will be 6307.10.1090, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: dustcloths, mop cloths and polishing cloths, of cotton other. The duty rate will be 4.1 percent ad valorem.

The multi-purpose cloths falls within textile category designation 369. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information as to whether quota and visa requirements apply to this merchandise, we suggest that you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” available at our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
