RE:     The tariff classification of window cling decorations from Taiwan.

Dear Mr. Carroll:

      In your letter dated November 5, 2004, and received on November 17, 2004, you requested a tariff classification ruling.

      You submitted samples of window cling assortments that measure approximately 17 inches in height and 12 inches in width and have pop-out, printed plastic window decorations pre-cut around the edges for easy removal. Static cling causes the pictures to adhere to a glass window.

Item number 80980570-502, Classic Angels, depicts four different angels with wings. The first angel is dressed in a gold outfit and holding flowers. The second angel is dressed in a red and gold outfit and she is blowing a horn. The third angel is dressed in a red and white outfit and she is playing a harp. The fourth angel is dressed in a red, gold and blue outfit and she is holding a long candle.

Item number 80981200-501,Glass Ornaments, depicts eleven glass Christmas tree ornaments. The ornaments are a Christmas stocking with gifts, Santa holding toys, a decorated Christmas tree with a star on top, a snowman dressed in a hat and scarf holding a candy cane, a teddy bear, a multicolored ball ornament, an oval shaped ornament, an oblong ornament, a wrapped Christmas present, a sleigh filled with toys and a snowman dressed in a top hat, scarf and mittens holding a broom.

Item number 80981600-501, Gifts and Ornaments, depicts seven Christmas tree ornaments and four Christmas presents in a variety of shapes and colors.

Item number 80981040-501, Bells, depicts bells in a variety of shapes and colors. The bells are designed to appear as Christmas ornaments without the loop hangers.

The applicable subheading for Item number 80980570-502, Classic Angels will be 4911.91.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for other (than certain enumerated) printed pictures, designs and photographs. The rate of duty will be free.

      The applicable subheading for Item number Item number 80981200-501, Glass Ornaments, Item number 80981600-501, Gifts and Ornaments and Item number 80981040-501, Bells, will be 9505.10.2500, HTS, which provides forArticles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

      This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
