RE: The tariff classification of a vanity case from China.

Dear Ms Kwok:

In your letter dated November 12, 2004 you requested a classification ruling for a vanity case.

The sample submitted is identified as “Grey Zipper Nylon Box”, CKC1005-621. The item appears to be a vanity case designed to provide storage, protection, organization and portability for personal effects. It is manufactured with an exterior surface of 100% nylon man-made fiber textile material. The top lid has a clear plastic window, a zipper closure and the interior is lined with textile materials. It measures approximately 7”(W) x 3”(H) x 6 ¼”(D). The case is fitted with a vacuum form packer tray specially shaped to hold four preparations.

The applicable subheading for item CKC1005-621 will be 4202.12.8070, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases, vanity cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.8 percent ad valorem.

HTS 4202.12.8070 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

You have asked whether this product is subject to antidumping duties or countervailing duties.
