RE: The tariff classification of printed plastic sleeve labels from Korea.

Dear Mr. Spraitzar:

In your letter dated November 11, 2004, you requested a tariff classification ruling on behalf of your client, Osio International, Inc. (Anaheim, CA).

You identify the products in question as “rolls of shrink-wrap sleeves for the labeling of Noni juice.” You state that the merchandise is manufactured by extruding PET film in a sheet form. The sheet is then printed with the applicable commercial information, folded over lengthwise and then seamed along its length, forming a kind of flattened tube. The product is then wound in rolls.

Following importation, your client’s customer will use the product to label bottles of Noni Juice (a health product). The imported sleeves will bear magnetic ink marks, which can be read by an electric eye to trigger a mechanism to cut the film to the desired length (i.e., into individual labels). A single sleeve, open at both ends, will be slid over the Noni bottle and shrunk by steam to fit.

A 14¾”-length sample sleeve encompassing two consecutive, identical labels was submitted for our examination. Each label is printed with the name of the product (“Premium Noni Juice”), quantity in the bottle (32 fl. oz.), ingredients, nutrition facts, suggested use, and distributor’s name and address. There are no adhesives anywhere on the sleeve.

The applicable subheading for the rolls of printed plastic sleeve labels will be 4911.99.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for other (non-enumerated) printed matter. The rate of duty will be Free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
