RE: The tariff classification of a hat from Bangladesh.

Dear Ms. Stubblefield:

In your letter dated November 18, 2004 you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style 6240, Sport Flex Wicking Low-Profile Cap is a baseball style cap composed of knit 100% polyester fabric. The hat has six panels at the crown, textile button at the top and a peak.

The applicable subheading for style 6240 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crochetedfelt or other textile fabricwhether or not lined or trimmed: Other: Of man-made fibers: Not in part of braid, Other: Other: Other.” The duty rate will be 20 cents/kg + 7% ad valorem. The textile category designation is 659.
